ALAN M. DERSHOWITZ is a Brooklyn native who has been called 'the nation's most peripatetic civil liberties lawyer' and one of its 'most distinguished defenders of individual rights,' 'the best-known criminal lawyer in the world,' 'the top lawyer of last resort,' and 'America's most public Jewish defender.' He is the Felix Frankfurter Professor of Law at Harvard Law School. The late radio broadcaster, Paul Harvey used to have a show entitled "The Rest of the Story". This book easily falls into that category.

I'd heard news reports of the accusations against Prof. Dershowitz related to pedophile Jeffrey Epstein. Those accusations were carried far & wide by main stream media and the flames were fanned even further by the #MeToo movement. But I've also seen Prof. Dershowitz being interviewed on television where he adamantly denied the charges. His denials have always been very forceful and seemed genuinely sincere. Given the distinct conflict between the charges and denials, my curiosity led me to buy & read his book.

I found Guilt by Accusation to be a very compelling & convincing account of the "rest of the story" that never seemed to make it into the main stream media. And that fact makes the book horrifying. Why horrifying?

First, generally speaking, Prof. Dershowitz's case is a clear example of a disturbing trend in the country where our U.S. Constitution is being turned upside down. Where instead of accusers having to PROVE beyond a reasonable doubt that the accused is guilty; suddenly and wrongly, the accused is ASSUMED to be guilty until THEY prove their own innocence.

Specifically the book is horrifying because while Prof. Dershowitz was very publicly accused...the FACT that he has been CLEARED OF THOSE CHARGES IN A COURT OF LAW, has never received wide publication. His book very clearly lays out how he was basically framed by unsavory characters who admittedly lied when making the charges. And how in spite of being cleared, the media in many cases has ignored that fact often even ignoring evidence of his innocence provided to them. Whether or not one buys into the concept of rampant "fake news", this book lays out very clear examples of fake news being intentionally disseminated in disturbing, if not criminal ways. And because of the misinformation campaign an innocent man has continued to be harassed by false charges.

The scary thing about this book is if this kind of miscarriage of justice can happen to someone of wealth and name recognition...someone with the financial & legal resources to fight the charges...one has to wonder as to the devastating impact it would have were the same false charges leveled against an innocent John or Jane Doe. The person would be ruined.

Although the book contains a lot of legal jargon, by necessity, it is easy to read and organized in a way to make clear what happened and why. All Prof. Dershowitz asks of his readers is to give him the same assumption of innocence afforded all of us in the Constitution when they start to read. If readers approach the book with that open mindset, the evidence of his innocence is thoroughly convincing.

I don't like Alan Dershowtz. I started to dislike him during the OJ criminal case. Not because he was defending OJ. Afterall, that was his job and the U.S. Constitution says that criminal defendants have the right to counsel. I started to dislike him because his ultra high level of self-promotion did not, in my opinion, match his record of achievement. I really started disliking this guy when he referred to himself as the OJ Criminal Defense Team's, "constitutional strategist." I am from Ohio and in Ohio we have a name for "constitutional strategists." We call them criminal defense lawyers. Let's face it. Dershowtz, what a windbag!

Why is what I just said important? Because too many people in this country think people "did it," or "did not do it," in both civil, criminal and administrative law cases based on the accused's politics, backgrounds, the color of their skin, their religious views, their educations and all sorts of other irrelevant stuff. But the problem is that the one and only thing -THE ONE & ONLY THING - that should matter is the evidence. Somewhere , sometime too many people forgot about that. Rule #1 in contested legal cases: Evidence talks and everything else should walk. Rule #2 is that people should listen carefully to the evidence and then evaluate it using good judgment.

That is one of the lessons Dershowtz makes in this insightful book. He does not say sexaul harrassment is not real, because it is. He does not say that sexual assualt is not real, because it is. He does not say rape is not real, because it is. He does not say that it is okay to sexually harass, assualt or rape anybody, because it is not okay. It is not even close to okay. It is always 100% wrong. (I hope I have made that point reasonably clear.)

What Dershowtz says is that just because somebody says, or claims or alleges some terrible sexual event happened, and that X (fill in the blank) did it, does not make it so. Only evidence can make it so. (Remember Rule #1, from above.)

So I recommend this book. Before you call me a Commie, or whatever it is they are calling people like me these days, please know that I am a lawyer who has successfully represented women in sexual harrassment cases, and I have successfully represented men in sexual assulat cases and in rape cases. Many years ago I spent about 5 or 10 minutes working as an Intern in the Office of Rep. Bella S. Abzug of New York, who, back in "olden times" was big in The Women's Movement. And back then, it was not always easy to be part of The Women's Movement. (Frankly, my feelings about Bella are sort of similar to my feelings about Professor Dershwotz. Sorry, Bella. You were very smart, very hard working and totally dedicated to your beliefs, but you should have mixed some crazy glue in with your toothpaste. You would have gone a lot farther in politics if you had.)

Which is all just another way of saying: Show me the evidence. Evidence talks and everything else walks. If you don't believe me, read this book.

I shudder when I think what western civilization would be like without people like Alan Dershowitz seeking justice. When I first started studying law I naively thought you were inocent until proven guilty, but 21 years later it seems that the opposite is true.

The interesting thing to come out of this book is not that innocent people can be maligned, which most of us knew already, but how the process of doing this for gain has been industrialised by the US claims industry. It must provide some comfort to Dershowitz's family that their true friends and fair minded members of the public alike can read his side of the story which is completely absent from Netflix, the press and the storm of pedo GIFS bombarding his Twitter account.

"Don't forget Alan Dershowitz. JE's buddy and lawyer..good name for your pitch as he repped Claus von Bulow and a movie was made about that case...title was Reversal of Fortune. If Dershowitz manages to demonstrate in court the construction of a false narrative in his case, it may cast some doubt on the accuracy of the allegations against Prince Andrew.

I have gone through an accusation . Prof Dershowitz asks that truth be sought, and not a successful prosecution. It is , by my experience possible that some people would make devastating allegations for money or revenge.
